Preamble
These General Terms and Conditions of Sale (GTC) are concluded between:
- SARL TL, located at 20 Boulevard du Jeu de paume in Montpellier, registered with the Trade and Companies Register under number 842 227 845 00034, intra-community VAT FR96842227845 (hereinafter referred to as "the Seller").
- And any natural or legal person wishing to make a purchase via the website bisousskateboards.com (hereinafter referred to as "the Client").
Purpose
These GTC aim to define the rights and obligations of the parties in the context of the online sale of products offered by the Seller to the client on the bisousskateboards.com website.
Products
The products offered are those listed on the bisousskateboards.com website. They are described and presented with the greatest possible accuracy. However, if errors or omissions may have occurred regarding this presentation, the seller's liability cannot be engaged.
Product characteristics
Products are offered within the limits of available stock. The seller reserves the right to modify the product assortment at any time.
Price
Product prices are indicated in euros, all taxes included (TTC). They do not include delivery charges, which will be invoiced additionally and specified at the time of order.
The seller reserves the right to modify its prices at any time, it being understood, however, that the price listed in the catalog on the day of the order will be the only one applicable to the Client.
Orders
The client places orders directly on the bisousskateboards.com website. Any order implies unreserved acceptance of these GTC.
Order process
- The client selects the products they wish to purchase.
- They confirm their order after verification.
- The client makes payment according to the proposed methods.
- The seller confirms receipt of the order by email.
The seller reserves the right to cancel any order from a client with whom there is a dispute relating to the payment of a previous order.
Payment
Payment for purchases is made by Apple Pay, Visa, American Express, Mastercard, and Paypal. Payment is due immediately upon order.
ALMA
Payment in installments with Alma.
If you pay for your order in installments, you accept Alma's customer general terms and conditions.
The individual Client has a period of 14 calendar days from the order date to waive the payment facility granted by Alma and must then pay in cash, by directly notifying their decision to withdraw to support@getalma.eu.)
In case of withdrawal, any fees paid to the Seller by the Client are reimbursed by the Seller (excluding return shipping costs for the order).
Delivery
Products are delivered to the address indicated by the Client during the order. The delivery time is 2 to 7 working days from the order confirmation, unless otherwise specified during the order.
Delivery charges
Delivery charges are the responsibility of the client and are automatically calculated during the order process.
In case of delivery delay, the Client will be informed by e-mail. The Seller cannot be held responsible in case of delay or delivery failure due to circumstances beyond its control (force majeure).
Right of withdrawal
In accordance with the law, the Client has a period of 14 days from the receipt of the products to exercise their right of withdrawal without having to justify reasons or pay penalties.
The Client must inform the Seller of their decision to withdraw by sending a request to bisousskateboards@gmail.com.
Exceptions
The right of withdrawal does not apply to personalized or custom-made products.
Return and refund
In the event of exercising the right of withdrawal, the Client must return the products in their original and complete condition (packaging, accessories, instructions). Return costs are borne by the Client.
The Seller undertakes to refund the Client within 5 days from the receipt of the returned products.
Warranties
The Seller is liable for defects in conformity of the products under the conditions provided for in Articles L217-4 et seq. of the Consumer Code and for hidden defects under the conditions provided for in Articles 1641 et seq. of the Civil Code.
Personal data
The personal information collected during the order is necessary for the management of the order and the commercial relationship between the Seller and the Client.
In accordance with the Data Protection Act of January 6, 1978, and the GDPR, the Client has a right to access, rectify, and oppose personal data concerning them, by contacting the Seller at bisousskateboards@gmail.com.
Intellectual property
All elements of the bisousskateboards.com website are and remain the intellectual and exclusive property of the Seller. Any partial or total reproduction is prohibited without express authorization.
Applicable law and competent jurisdiction
These GTC are subject to French law. In case of dispute, the competent courts will be those of the Client's domicile or those designated by the rules of civil procedure.
Dispute mediation
In accordance with Article L616-1 of the Consumer Code, the Client has the possibility of resorting to a mediator to resolve a dispute with the Seller amicably.
